Focus Column - Alternative Dispute Resolution - By June Lehrman - In a mediation concerning sexual abuse claims against the Roman Catholic Diocese of Orange, the mediator (a sitting superior court judge) issued a "valuation order" purporting to determine the settlement value of the claims. In Travelers Casualty & Surety Co. v. Superior Court , 2005 DJDAR 1869, the 2nd District Court of Appeal vacated that order, finding it was improperly coercive and that it violated fundamental principles
