The 4th District Court of Appeal on Wednesday declined to publish an opinion that affirms a new trial for an Orange County murder convict over previously undisclosed informant records. The panel that wrote the opinion then forwarded the publication request, which was from the Los Angeles County public defender’s office, to the state Supreme Court and recommended it be denied.
