Judge: Marin County fee on all residential projects is constitutional

The judge rejected a writ petition from the Pacific Legal Foundation, which argued the fees should not apply to small property owners.

A judge has ruled that an affordable housing fee imposed on residential projects in Marin County is constitutional, rejecting a writ petition from the Pacific Legal Foundation.

The decision by Marin County Superior Court Judge Roy O. Chernus concerning the fee imposed under state law was a tentative ruling issued Tuesday. But attorneys didn’t challenge it and oral arguments scheduled for Wednesday were vacated.
