Theranos executives’ defense may have holes, legal observer says

The founder and chief operating officer of purported revolutionary blood testing company Theranos have been indicted on wire fraud charges, allegations strongly denied by one of their attorneys.

Almost instantly after Theranos’ two top executives were indicted Friday, a defense lawyer began laying out a defense: They lost money, too.

But that isn’t a foolproof defense, according to Kenneth P. White, who has prosecuted and defended white-collar crimes but is not involved in this case.
