New DOJ guidance may curb the appointment of compliance monitors

During a speech delivered last month at the NYU School of Law Program on Corporate Compliance and Enforcement, Assistant Attorney General Benczkowski presented a memorandum on policy for the selection and appointment of corporate compliance monitors in connection with non-prosecution agreements, deferred prosecution agreements, and plea agreements with companies entering into resolutions with the Criminal Division.
