US Supreme Court dismisses securities case, leaving fight over tender offer litigation for another day

The U.S. Supreme Court on Tuesday punted a securities case testing the standard of liability for companies charged with misleading investors during the course of a tender offer, leaving in place, for the time being, a circuit split making it easier to pursue claims under the Securities Exchange Act of 1934 on the West Coast.
