Mediation is an increasingly popular form of alternative dispute resolution. Not only does it expedite resolutions, it keeps costs down and relieves burdens on both the court and the parties in dispute. The prevailing model in California is caucus-based, but there is another model gaining popularity called the "understanding model." It is championed by many mediation programs, including the Program on Negotiation at Harvard Law School.
