9th Circuit to hear appeal of dismissal under Speedy Trial Act

Frustrated by the pause on jury trials in the Central District of California,U.S. District Judge Cormac J. Carney, who sits in Santa Ana, tossed out Olsen’s indictment with prejudice last fall.

The 9th U.S. Circuit Court of Appeals on Thursday will hear the appeal of a dismissal of an indictment based on the fact that federal jury trials have been suspended since the start of the pandemic. The same district court judge continues to toss out cases, citing violations of the Speedy Trial Act, and will likely continue to do so until the appeals court steps in.
