Size of malpractice payouts rose in 2020, survey finds

Insurance brokerage Ames & Gough’s annual legal malpractice claims survey asked 11 insurance companies about their business from the past year. The survey found that while the number of new legal malpractice claims remained flat in 2020, the size of payouts surged.

Despite a dramatic slowdown in court business, the size of legal malpractice claim payouts remained at an all-time high throughout 2020, according to a new survey. But warnings of a surge in claims stemming from the pandemic were exaggerated, some lawyers said.
