Millions of workers benefit from state Supreme Court ruling

Dennis F. Moss, an attorney with Moss Bollinger LLP who represented the plaintiffs, said many companies will have to make changes in how they calculate “premium pay” for workers when they don’t get meal and rest breaks.

In a decision expected to affect millions of California workers, the state Supreme Court ruled Thursday that employers who do not provide meal and rest breaks must pay more when calculating extra pay.

The unanimous decision reverses a 2nd District Court of Appeal decision in favor of Hollywood Loews Hotel LLC in a class action filed by a former bartender who received quarterly incentive payments along with her hourly wages.
