Tele-dentistry says state board should face antitrust claims

Arguing before a three-judge circuit l Monday, Chicago plaintiffs’ attorney James Dasso of Foley & Lardner LLP, said the board had unfairly targeted the company because it’s tele-dentistry business model — which allows patients to be fitted for braces without seeing a dentist in person — posed a threat to traditional dentist practices.

A state dental board abused its regulatory power and should face antitrust claims after it unfairly investigated tele-dentistry company SmileDirectClubb LLC, an attorney said this week in requesting the 9th U.S. Circuit Court of Appeals revive a lawsuit.
