Mormon church seeks summary dismissal of ex-member’s tithing suit

James Huntsman claims the church fraudulently used millions in tithes for commercial rather than charitable purposes. The church, represented by Rick Richmond of Larson LLP, says it is protected by the First Amendment and all of the funds for the project came from earnings on its invested reserve funds and commercial entities affiliated with it.

Moving for summary judgment Monday, the Church of Jesus Christ of Latter-day Saints said the First Amendment shields it from a lawsuit filed by prominent Utah family member James Huntsman, who claims the church fraudulently used millions in tithes for commercial rather than charitable purposes.
