Panel affirms magistrate judges ruling in ‘unconscious racism’ case

Idaho State University Jun Yu’s attorney relied on expert testimony by Dr. Leslie Wade Zorwick, a psychology professor at Hendrix College, who said he was a victim of “aversive racism” -- a theory of prejudice she compared to unconscious or implicit bias.

A Chinese doctoral student who claimed he was a victim of a form of unconscious bias lost his appeal Tuesday against a university that kicked him out of its clinical psychology program.

A 9th U.S. Circuit Court of Appeals panel affirmed an Idaho magistrate judge's opinion in favor of Idaho State University, which dismissed Jun Yu from its program in 2013 after an unsuccessful internship at the Cleveland Clinic.
