LA Fitness $500M dispute with 11 insurers moves forward
The Zurich America Insurance Co. suit in Orange County is the third action in this sprawling dispute. LA Fitness filed a suit in King County, Washington after dismissing a federal lawsuit it filed against Zurich in the Central District of California. The fitness company dismissed the federal action two days before U.S. District Judge James V. Selna was to issue a tentative ruling on the insurers’ motion to dismiss, according to Zurich.
LA Fitness' $500 million pandemic-related insurance dispute with 11 insurance carriers is moving forward in Orange County but could face tough odds as appellate courts in California continue to rule for insurers.
Arguing in a demurrer filed this month in Orange County Superior Court, Zurich American Insurance Co. said LA Fitness is trying to rewrite insurance contracts to impose financial obligations insurers never agreed to undertake.
