En banc review for state’s COVID restrictions on private schools

A divided three-judge panel had ruled against the state in a case filed by parents, deciding the dispute was not moot even though California has since dropped the pandemic restrictions. The en banc review was announced Wednesday.

The 9th U.S. Circuit Court of Appeals vacated an order against the state's COVID-19 restrictions on private schools and will consider the matter en banc.
