Supreme Court limits local authority to ban fracking

The unanimous state Supreme Court found that the state, as directed by the Legislature and governor, had “fully occupied” the field of regulation that Monterey County was attempting to control.

A unanimous California Supreme Court gave Chevron U.S.A. a third straight win Thursday in its battle to stop Monterey County’s fracking ban.

Justice Martin J. Jenkins’ opinion means that those who want to limit oil and gas drilling methods must do so at the state level.
