Musk, Cuban ask U.S. Supreme Court to curb administrative law judges

“The central issue of the case is whether people have the right to a jury,” said Nicolas Morgan, a partner with Paul Hastings LLP in Los Angeles who filed an amicus brief on behalf of Elon Musk, Mark Cuban, and others who are described as “sophisticated” investors.

A group of investors who say their successful jury trials spooked the Securities and Exchange Commission into bringing fewer cases in district court, asked the U.S. Supreme Court to use an upcoming case to curb the powers of administrative law courts.
