High court to decide time limit for bringing insurance suits
“When a plaintiff files an action against the plaintiff’s insurer for injunctive relief under the Unfair Competition Law, which limitations period applies, the one-year limitations period authorized by Insurance Code … or the four-year statute of limitations in [the] Business and Professions Code?” the court review order stated.




The California Supreme Court granted review of an appellate court finding that lawsuits against insurers under the Unfair Competition Law must be brought within one year of loss or damage. The justices will re-examine the ruling against an individual plaintiff who argued that California law allows for a four-year window to file.
