Judge leery of infringemnt case against Nintendo
The case before Chief U.S. District Judge Richard Seeborg has the same set of facts and experts as a recent International Trade Commission ruling in Nintendo’s favor, but the judge reminded the attorneys on multiple occasions that he is not bound by the ITC’s decisions.
Nintendo attorneys argued in court that the design for its latest console, the Switch, did not infringe on the copyright of accessories that allow gamers to use a joystick and buttons when playing games on their phones or tablets.
