Oakland breached lease deal for shipping terminal, judge says

Judge Noël Wise's 96-page document tentative ruling says that the question before the court was whether the record that the city council relied on had evidence that coal operations would endanger public health.

An Alameda County judge tentatively ruled that the city of Oakland breached a ground lease agreement with the developer of a bulk shipping terminal at the Port of Oakland when it issued a coal ban at the site.

Superior Court Judge Noël Wise's proposed statement of decision, if adopted, could bring to an end nearly five years of litigation. The 96-page document, issued Friday, says that the question before the court was not whether there was evidence to support the Oakland City ...
