Dow needn’t pay punitive damages to Modesto, jury says

"Plaintiffs lack any property or appropriative interest in that groundwater, which is owned by the State -- not the City," Dow's attorneys from Latham & Watkins argued in their filings.

The Dow Chemical Company and PPG Industries Inc., a leading paint manufacturer, was held liable for negligence by a San Francisco jury but will not have to pay the City of Modesto punitive damages for its alleged failure to adequately warn consumers about the toxicity of its cleaning products containing chlorinated solvents.
