2 views battle in Sacramento over open carry gun ban

The plaintiffs say the state has denied them their 14th Amendment due process rights under its “may issue” standard for gun carry permits.

Both sides appeared to struggle with the fast changing understanding of Second Amendment law during a hearing Friday in a federal case challenging two state laws imposing criminal penalties on people who openly carry guns in public.

Each side also presented a very different version of the history of America’s gun laws and what constitutes a “historical analogue” during arguments in the Eastern District of California.
