Justices mull trial judges’ authority to strike PAGA claims

Several justices seemed supportive of giving judges the power to strike claims, worried about lengthy trials — or a series of mini-trials that would last years.

The state Supreme Court considered arguments Wednesday over whether trial court judges can strike claims brought under the Private Attorneys General Act if trying them all would be unmanageable.

The justices will resolve a split between two state appellate courts that came to different conclusions about whether Superior Court judges have the inherent authority to strike PAGA claims to prevent cases from dragging on for years.
