Negligence suit against PG&E would interfere with regulator, high court says
The state Supreme Court’s decision will go back to the 9th Circuit panel that asked the question and will decide Gantner’s appeal.
The state Supreme Court, answering a question from the 9th U.S. Circuit Court of Appeals, on Monday affirmed a decision by a district judge barring a man’s class action against Pacific Gas & Electric Corp.
Anthony Gantner argued that plaintiffs were entitled to as much as $2.5 billion in damages because the utility was negligent in maintaining its power grid, prompting shutoffs in 2019.
