Defense: Experts can’t prove Girardi exaggerated dementia

Following a three-day hearing that began in August, U.S. District Judge Josephine L. Staton will have to decide if Girardi is competent to stand trial on five wire fraud charges that include bilking $15 million from five clients.

The federal judge deciding if disbarred lawyer Thomas V. Girardi is competent to stand trial has now received post-hearing briefs from both sides. The Department of Justice says his behavior during the competency proceeding shows that he is aware enough to aid in his defense, while his lawyers say the government’s experts weren’t qualified to make such an assessment.
