9th Circuit rejects challenge to Diablo Canyon exemption

The nuclear power plant had been scheduled to be decommissioned next year, but the state Legislature passed a bill, SB 846, in 2022 that approved Pacific Gas & Electric Co.'s continued use of the facility due to climate change and California's need for "carbon free electricity."

A 9th U.S. Circuit Court of Appeals panel on Monday denied a petition by several groups opposed to the Diablo Canyon nuclear power plant which argued that the U.S. Nuclear Regulatory Commission wrongly granted an exemption that allowed the plant to continue operating.
