Judge rules in favor of Dave & Busters in wages case

The defense had argued that the plaintiff had been included in a previous settlement.

Restaurant and arcade chain Dave & Busters won judgment on the pleadings in a prospective representative action by an employee claiming the company failed to provide break periods, pay full wages or provide accurate wage statements.

Judge Rupert A. Byrdsong granted the company's motion in a hearing on Thursday, although he had questions regarding the exhaustion of administrative remedies in the case.
