Judge won't disqualify firm that employs councilmember from rent control case

While the "appearance of impropriety is a concern," Judge William Claster said plaintiffs lack standing to remove the firm from the case.

A law firm that employs a member of the Santa Ana City Council can continue to litigate a case involving a rent control ordinance she voted for, an Orange County judge ruled, despite a federal judge reaching the opposite conclusion. Rutan & Tucker LLP will continue to represent defendant Advanced Management Company in a lawsuit alleging unlawful rent increases even though associate Thai V. Phan was the deciding vote in favor of the rent stabilization ordinance at issue in the case.
