Defense attorneys voice concern over PAGA cure process

Rather than reducing the number of claims, defense attorneys argue recent changes to the PAGA law could have the unintended consequence of encouraging more.

Employment defense attorneys are concerned that recent changes to the Private Attorneys General Act, signed July 1 by Gov. Gavin Newsom, will increase case filings despite his messaging to the contrary.

Newsom signed two bills, AB 2228 and SB 92, altering the statute to reflect a compromise deal reached between legislators and labor and business groups to avoid a Nov. 5 proposed ballot initiative that would have repealed PAGA altogether.
