MGA seeks mistrial or jury warning in 3rd trial over dolls' likeness claims
For the third time in two years, a jury is hearing counterclaims from members of a defunct female pop group, the OMG Girlz, who claimed MGA infringed their likeness and caused consumer confusion by releasing a line of dolls called, "L.O.L. Surprise! O.M.G."
Attorneys defending toymaker MGA Entertainment Inc. from multimillion-dollar trade dress claims accused opposing counsel of feeding their witness false information regarding the scope of the infringement claims and urged the judge on Thursday to either declare a mistrial or issue a jury instruction that makes clear the alleged misconduct was improper.
