Private prison operator sues to block state inspections
In its complaint, the Geo Group Inc. said SB 1132 violates the supremacy clause of the U.S. Constitution and should be enjoined. Similar arguments have been used successfully to strike down previous state efforts to regulate federal detention facilities.
A private prison operator with a litigious history with the state has sued to block a new California law allowing health inspections at its facilities. The Geo Group Inc. argued that SB 1132 failed to exploit a "narrow" exception identified in Trump-era litigation that allows states to inspect private lockups.
