Split circuit affirms OpenAI Inc as senior holder of mark

The 9th Circuit ruled 2-1 affirming U.S. District Judge Yvonne Gonzalez Rogers of Oakland, who granted the preliminary injunction in OpenAI's favor, questioning the legitimacy of the smaller company, which was founded by Guy Ravine.

A divided 9th U.S. Circuit Court of Appeals panel has affirmed a preliminary injunction in favor of OpenAI Inc., the company behind the popular ChatGPT chatbot and the Dall-E text-to-image generator in a trademark infringement dispute.

The dispute pits OpenAI against another company, Open Artificial Intelligence Inc., in a dispute over which holds the senior mark.
