San Bernardino County seeks to dismiss false imprisonment suit

San Bernardino County attorneys seek to dismiss a lawsuit by a former school custodian, acquitted of child assault, who alleges he was wrongfully prosecuted. The defense cites lack of evidence and prosecutorial immunity.

San Bernardino County, its sheriff's department and a prosecutor moved to dismiss a federal lawsuit by a former elementary school custodian who claimed he was unlawfully investigated and jailed for nearly five years on child sexual assault charges that a jury found he didn't commit.

San Bernardino County Counsel attorneys Thomas D. Bunton and Michael E. Jewell argued the case should be dropped because the plaintiff's allegations lacked support to hold the county liable...
