9th Circuit asks state Supreme Court to weigh life insurance law

A federal appellate panel has asked the California Supreme Court to determine whether the state's "lapse statutes" protecting policyholders who miss a life insurance payment apply to policies originally issued in another state. The case stems from a $2 million policy denial after a California resident failed to make a timely payment.

A 9th U.S. Circuit Court of Appeals panel asked the state Supreme Court on Thursday whether California laws designed to protect people who miss a payment on their life insurance policies apply if they are issued in another state.

Susan Pitt sued her husband's insurer, Metropolitan Tower Life Insurance Co., because it denied a $2 million policy after he died.
