Fatal car chase lawsuit heads to trial, claims policy failures

A father's lawsuit over a deadly sheriff's car chase survives dismissal. He challenged Santa Clara County's pursuit policies and immunity claims after a crash killed his children.

A judge denied a motion for summary judgment in a case against Santa Clara County on Tuesday that could impact its sheriff's office's car pursuit policies. The plaintiff's lead counsel claims "an out-of-control cowboy cop" acted negligently during a car pursuit that killed a brother and sister in a highway collision.
