Judge mulls meaning of 'and' in LA's bid to toss $1.2B tower project suit

The city claimed it had terminated the agreement because it was breached when one of three agreed-upon investors improperly transferred its interests to the other two.

A Los Angeles County judge will decide whether to grant the city's demurrers against the developers of a stalled $1.2 billion tower construction project downtown.

Judge Richard L. Fruin tentatively granted the city's demurrer as to breach of implied good faith covenant and unjust enrichment while overruling as to breach of contract. However, he elected to take the matter under submission after inviting counsel on Tuesday to "tell me I'm wrong."
