Litigation director rebuked by judge denies wrongdoing, client seeks new trial

After a 67-day trial, Judge JoAnne McCracken criticized attorney Stephan Barber for false statements in the homeowner's association negligence case, but he said he his statements were true, noting he has never been disciplined in 49 years of practice.

A homeowner's association ordered to pay $1.8 million for water damage and mold at a condominium with a hidden well under it has filed a motion for a new trial, said its former attorney, Stephan A. Barber, who was accused by the Santa Clara County judge of making extensive false statements in a letter on behalf of his client.
