State appeals court tosses Byron Allen ad suit against McDonald's

The 2nd District Court of Appeal affirmed the dismissal of Byron Allen's state lawsuit against McDonald's, finding the company never promised to spend ad dollars with his media firms. A separate federal discrimination suit is still set for trial.

A California appellate court has upheld the dismissal of a lawsuit by media mogul Byron Allen against McDonald's Corp., ruling the fast-food giant made no enforceable promise to increase ad spending with his Black-owned media companies -- though a separate federal discrimination suit remains on track for trial.
