LA judge lets school district to add MICRA defenses in overdose suit
A Los Angeles judge tentatively permits LAUSD to file MICRA defenses in a lawsuit over a student's fatal overdose, despite claims the law doesn't apply to school negligence.
A Superior Court judge tentatively granted the Los Angeles Unified School District leave to file defenses under the state Medical Injury Compensation Reform Act (MICRA) in a wrongful death case by a mother whose daughter fatally overdosed while in the school's care.
The district argued claims against a school medical officer fall under MICRA, which places conditions and limits on actions against health care providers for professional negligence.
