Monster Energy prevails on appeal in record $311M false advertising case
A 9th U.S. Circuit Court of Appeals panel on Tuesday upheld what is believed to be the largest Lanham Act verdict in history in a false advertising lawsuit brought by Monster Energy against Vital Pharmaceuticals and its former CEO.




A 9th U.S. Circuit Court of Appeals panel on Tuesday affirmed a $293 million verdict in a false advertising lawsuit by Monster Energy Inc. against Vital Pharmaceuticals Inc. and its chief executive officer.
The unpublished opinion affirms what is believed to be the largest Lanham Act verdict in history, according to Los Angeles law firm Hueston Hennigan LLP, which represented Monster in the case.
