Civil trial lawyers are all familiar with a mediator's proposal. The settlement device is typically the final tactic in a neutral's toolbox to bridge a gap between the parties. Since retiring from the Los Angeles Superior Court, I have made mediator proposals in cases only where I think it will work because the parties truly desire to resolve their dispute rather than engage in further discovery and incur expert fees.
