State Supreme Court to decide if speedy trial demand from jail was valid

The case could settle a longstanding conflict among appellate courts over how Penal Code Section 1381 applies when a defendant has not yet been physically transferred to a state prison.

The California Supreme Court will decide whether a felony assault charge was wrongly dismissed after a man already sentenced to state prison demanded a speedy trial from county jail. The case could resolve a split in appellate courts over when such demands are valid under Penal Code Section 1381.
