Judge allows probe into Trump's military use
Senior U.S. District Judge Charles R. Breyer permits expedited discovery into possible Posse Comitatus Act violations, rejecting President Donald Trump's jurisdictional challenge, in a mixed ruling for California's fight against federalized National Guard deployment.




A federal judge in San Francisco has ruled that attorneys for the state can get expedited discovery to determine possible violations of the Posse Comitatus Act of 1878, which bars the use of federal military forces for domestic law enforcement, rejecting the Trump administration's argument that the judge shouldn't have jurisdiction over the case.
