Judge extends bail time for deputy after rare DOJ motion

A federal judge paused a former deputy's prison term amid a rare dispute over prosecutors' post-sentencing attempt to dismiss a case, raising novel questions about Rule 48 and separation of powers.

An unsuccessful, yet rare, move from the government to dismiss a criminal case it successfully prosecuted is central to a pending appellate dispute that's keeping a convicted Los Angeles County deputy sheriff out of prison, a judge ruled.
