Musk's lawsuit over AI turning for-profit will go to jury, judge says

A federal judge signaled Elon Musk's fraud and RICO lawsuit against OpenAI will proceed to a jury, rejecting the company's bid for summary judgment over its transition to a for-profit structure.

Elon Musk's lawsuit against OpenAI over allegations its founder, Sam Altman, misrepresented his intentions for the venture to secure Musk's support appears headed to trial.

U.S. District Judge Yvonne Gonzales Rogers said Wednesday she intends to deny OpenAI's motion for summary judgment during a hearing in Oakland reported by The Associated Press.

Musk helped found OpenAI in 2015 before leaving its board in 2018. He's since founded his own competitor, xAI....
