Federal judge weighs staying discovery in xAI suit against OpenAI

U.S. District Judge Rita F. Lin suggested applying discovery controls used in patent litigation to an algorithm-theft case involving competing artificial intelligence developers.

U.S. District Judge Rita F. Lin said she is leaning toward staying discovery until a motion to dismiss is heard in a high-profile lawsuit between Elon Musk's xAI and competitor OpenAI.

Lin said she plans to set a deadline at which point xAI can't claim any additional trade secrets. She said it's a strategy she's seen used to manage patent lawsuits, and she hopes to apply it to algorithm-theft cases, which are increasingly common.
