Pacific Bell gets wage class action dismissed as preempted

A federal judge dismissed a putative class action alleging Pacific Bell underpaid training differentials, ruling the claims were preempted by federal labor law and barred for failure to exhaust grievance procedures.

U.S. District Judge Josephine L. Staton dismissed a putative class action against Pacific Bell Telephone Company, granting a significant legal victory to the utility provider in a complex labor dispute, said attorneys from Munger, Tolles & Olson LLP.
