I've been in private practice for 48 years, handling primarily business, real estate and general civil litigation and trial work; some cases big, some small. I've represented large companies, including one of the largest real estate brokerages in the United States here in Southern California, a major Bank, and a lot of small businesses and individuals. I am now retiring from the practice of law in order to devote my time and attention to Mediation with ARC, through which I've been working as a Mediator for the past five years.
According to some estimates, over 90% of cases filed in the Los Angeles Superior Court settle before trial. What that tells us is that most cases can be settled. Mediating before the right Mediator can be a golden opportunity to put a case to rest, and avoid the cost, risk and headaches associated with litigating and bringing the case to trial. The ability of the Mediator to settle a case may depend on when it is ripe for settlement. A good Mediator will be keenly aware of factors that have nothing to do with the facts of the case or the applicable law; for example, ongoing costs, closeness of the case to trial, emotions of the parties and other factors extraneous to the case. Whatever the reason, Mediation is an opportunity to bring peace to parties who have been fighting, sometimes like cats-and-dogs and sometimes for years. If the Mediator is able to focus on these other factors along with the facts and the law, it is amazing what a Mediator can do to bring peace to an otherwise warring situation.
I have been remarkably successful in helping warring parties find peaceful resolutions of their disputes for over thirty years as an advocate, and for the past five years as a Mediator with ARC. I find my services as a Mediator to be far more gratifying and, in some ways challenging, than those as an advocate bollixed up in years of costly litigation.
