As a senior deputy district attorney, David R. Elgin was skeptical of the newly appointed judge presiding over his gang case in Merced County Superior Court 12 years ago. Brian L. McCabe wasn't just a rookie: He'd spent 15 years as a civil attorney with little criminal law experience.
