SAN JOSE - Four years ago, Santa Clara County Superior Court Judge Kevin J. Murphy announced he'd be stepping down to become chief deputy for newly elected District Attorney Dolores Carr.

He spoke too soon.

Questions about whether Murphy was legally allowed to accept a new government job before the end of his six-year term as a judge scuttled his plans.
